Terms and Conditions

The Biosecurity Portal (BSP) is a product and service owned and operated by Plant Health Australia Limited.

The BSP has its own separate identity but in this web site we may sometimes use 'the Portal', 'Portal sites', 'we' or 'us' when we refer to the Biosecurity Portal in general. For the purposes of these terms and conditions, 'this web site' means the biosecurityportal.org.au site, which also includes links to non-government and government sites which are external web sites.

Consent to comply with the Terms and Conditions of use of the BSP services is a requirement of every registered user and is included in the registration process.

Proper Use and Behaviour

By using or registering for this website you agree that you are responsible for your own use of this service, for any posts you make, and for any consequences thereof. You agree that you will use the service in compliance with all applicable local, state, national, and international laws, rules and regulations, including any laws regarding the transmission of data. We retain the right to determine whether particular actions constitute unacceptable use on a case-by-case basis. It is unacceptable to and you must not create, store, transmit, access or fail to discourage receipt of material that is:

  • Pornographic, offensive, obscene or indecent;
  • Sexual or otherwise inappropriate;
  • Likely to cause harassment, insult or anxiety;
  • defamatory;
  • likely to infringe copyright or any other intellectual property right or breach confidentiality; or
  • likely to expose Us to legal liability, embarrassment or adverse publicity.

It is unacceptable to use this system to:

  • Gain unauthorised access to information or facilities;
  • Corrupt or destroy data;
  • Impair communications of a computer system without authorization;
  • Violate the privacy of others;
  • Impersonate another person;
  • Mislead or deceive; or
  • transmit commercial electronic messages that do not comply with the Spam Act 2003 (Cth)

Any use that violates Commonwealth and state laws is prohibited and will be reported to the relevant authorities.

Collection of Personal Information and Privacy

Personal information collected by the Biosecurity Portal is treated as confidential as specified below, and is protected by the Privacy Act 1988 (Cth).

Personal information is information relating to an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion provided.

When you register on this site, e-mail the BSP, use an on-line form, enter a user-profile or contribute your details to an Expert Registry:

  • We will record your name, e-mail address, telephone number, occupation, organisation, area of interest and other personal information provided;
  • Your details are required to meet security requirements and for the delivery, administration and ongoing development of the BSP services and reasonably associated tasks;
  • We may contact you in relation to the BSP services and/or send you information relevant to your membership and use of the BSP. If you do not wish to receive such information, please contact the BSP Administrator at BSPAdmin@phau.com.au. We will not provide your details to any third party mailing list;
  • Details regarding your purpose of use of the BSP, use of particular services, sectoral origin, work discipline, and organisation may be used in the production of analytical reports for the BSP and in provision of a service for third party users of the BSP;
  • We will not use information from which your identity is apparent or can reasonably be ascertained for any other purpose without your consent;
  • Information about your BSP membership and usage may be provided to your organisation (as nominated by you) at its request;
  • Unless otherwise required by law, apart from that described above, we will not disclose any information you submit without your prior permission; and
  • The BSP uses reasonable endeavours to ensure the accuracy of personal information recorded. Please keep us informed of any changes to your personal information. Please contact us if you wish to access the record of your personal information kept by the BSP and/or if you believe any of your personal information on the BSP' record is incorrect.

 

We will, at your request, provide you with access to any information which we have collected about you through this Portal in accordance with Australian Privacy Principles, Privacy Act 1988 (Cth). To gain access to this information you should contact the BSP Administrator at BSPAdmin@phau.com.au. If you believe that any information is inaccurate, incomplete or out of date, please contact the BSP Administrator at BSPAdmin@phau.com.au and they will revise the relevant information in accordance with Privacy Principles, Privacy Act 1988 (Cth).

Site Visit Data

When visiting this site, a record of your visit is logged. The following information is recorded for statistical purposes and is used by the Portal to help improve the site and provide analytic reports to our clients. Details that identify an individual will not be used in analytic reports. The following information is supplied by your browser:

  • the user's Internet Protocol (IP) address or their Internet Service Provider's IP address;
  • the user's operating system (for example Windows, Mac,);
  • the user's top level domain name (for example .com, .gov, .au, .uk);
  • the date and time of the visit to the site;
  • the pages accessed and the documents downloaded;
  • the previous site visited; and
  • the type of browser used.

No attempt will be made to identify users or their browsing activities unless required by law, such as in the unlikely event of an investigation, where a law enforcement agency may exercise a warrant to inspect the Internet Service Provider's logs.
